Hospital: HB 4557 Passed 3/06: (2.5) A registered nurse licensed under the Nursing and Advanced Practice Nursing Act and qualified by training and experience in operating room nursing shall be present in the operating room and function as the circulating nurse during all invasive or operative procedures. For purposes of this paragraph (2.5), "circulating nurse" means a registered nurse who is responsible for coordinating all nursing care, patient safety needs, and the needs of the surgical team in the operating room during an invasive or operative procedure.

Registered Nurse First Assistants (RNFAs)

Reimbursement:  Illinois Compiled Statutes, Chapter 210, Act 85, 10.7 [Similar provision for Ambulatory Surgical Centers at Act 5, 6.5] (2) Operative surgical procedures shall be performed only by a physician licensed to practice medicine in all its branches under the Medical Practice Act of 1987, a dentist licensed under the Illinois Dental Practice Act, or a podiatrist licensed under the Podiatric Medical Practice Act of 1987, with medical staff membership and surgical clinical privileges granted at the hospital. A licensed physician, dentist, or podiatrist may be assisted by a physician licensed to practice medicine in all its branches, dentist, dental assistant, podiatrist, licensed advanced practice nurse, licensed physician assistant, licensed registered nurse, licensed practical nurse, surgical assistant, surgical technician, or other individuals granted clinical privileges to assist in surgery at the hospital. Payment for services rendered by an assistant in surgery who is not a hospital employee shall be paid at the appropriate non-physician modifier rate if the payor would have made payment had the same services been provided by a physician.

HB 12 — 2013 Hospital Patient Protection Act
Creates the Hospital Patient Protection Act. Provides for minimum direct care registered nurse-to-patient staffing ratios in hospitals, and requires hospitals to have a written staffing plan. Sets forth essential functions of direct care registered nurses relating to hospital patient care. Sets forth certain rights of direct care registered nurses, including the rights to protected speech and patient advocacy. Prohibits a hospital from interfering with a nurse's exercise of those rights, and prohibits other retaliatory or discriminatory action by a hospital. Provides for monetary and equitable relief for violations of the Act, and provides for civil penalties. Requires a hospital to post certain provisions of the Act for review by the hospital's employees and patients and by the public. Amends the Hospital Licensing Act and the Nurse Practice Act to provide that in the case of a conflict between a provision of either of those Acts and a provision of the Hospital Patient Protection Act, the Hospital Patient Protection Act shall control.

Amends the Nurse Practice Act; creates the Primary Care Workforce Investment Fund for the purposes of providing individuals seeking licensure as an advanced practice nurse with increased opportunities to complete the clinical hours required for licensure and increased access to clinical preceptors who are qualified to teach, supervise, and evaluate these individuals; provides that the fund is also intended to address the State-wide shortage of a primary care workforce
