Las Vegas Pain Doc Agrees to $1.25M Billing Fraud Settlement

Government accused Dr. Brian Lemper of overbilling federal health programs over a 3-year period.


Anesthesiologist Brian Lemper, DO, has agreed to pay $1.25 million to settle allegations that he overbilled the Federal Employee Health Benefits Program and the Military Health System for surgical procedures and supplies during a 3-year period.

Dr. Lemper, who practices at the Lemper Pain Centers in Las Vegas, Nev., settled the case with the federal government in December 2010, before any charges were filed, according to the U.S. Attorney's Office for the District of Nevada.

In the settlement agreement, Dr. Lemper admits no guilt in the government's allegations that he overbilled from October 2004 through August 2007. The allegations were the result of an investigation conducted by the Office of the Inspector General of the Department of Health and Human Services. Dr. Lemper did not respond to a request for comment for this article.

According to the settlement, Dr. Lemper must pay the $1.25 million by Jan. 10.
