Surgical Assistant Catches Nurse Anesthetist Fondling Himself in OR

The cellphone video is part of a lawsuit that allegedly shows a pattern of sexual harassment at a California hospital.

A surgical tech who claims she's the victim of sexual harassment from a CRNA and a surgeon caught one of her tormenters red-handed. Shocking cellphone video made public recently shows nurse anesthetist Richard McGrory exposing himself and masturbating during a case.

Kevin Little, an attorney for surgical tech Nuvia Green, released the video as part of a lawsuit Ms. Green filed that allegedly shows a pattern of sexual harassment, retaliation and cover-up at Adventist Medical Center in Hanford, Calif.

We obtained a copy of the cellphone video, but deemed it too graphic to publish. It shows a man in scrubs pleasuring himself in what appears to be an OR. The hand of an apparent anesthetized patient is in view. The video does not show the man's face, and there is no evidence to prove it occurred at Adventist Medical Center.

Ms. Green sued the hospital, Mr. McGrory and urologist Seetharaman Ashok, MD, 57. In the lawsuit, Ms. Green accuses Dr. Ashok of making inappropriate comments, sexual overtures, forcibly kissing and grabbing her, and pushing his privates against her in sexual ways. Ms. Green says Adventist Medical's administration failed to respond when she reported Dr. Ashok's actions.

Dr. Ashok reportedly retaliated against Ms. Green for snitching by spreading rumors that she enjoyed his advances, stalking her in the hospital's parking lot and buzzing by her in his car at unsafe speeds. He also allegedly made false claims of professional misconduct against Ms. Green's workplace friend Amy Miller, an imaging technician who is also named as an accuser in the lawsuit.

Dr. Ashok wasn't the only one acting inappropriately, according to the lawsuit. Mr. McGrory purportedly exposed himself to Ms. Green during surgery when he was behind a curtain, but in direct view of where she had to stand while assisting the surgical team. Ms. Green accuses Mr. McGrory of pleasuring himself to orgasm during multiple surgeries, and resorted to videoing him in action to document the alleged behavior.

Ms. Green believes the hospital's inaction against Dr. Ashok created an environment where sexual misconduct was allowed to continue without consequence, which encouraged Mr. McGory's behavior. The hospital ultimately let Mr. McGory resign with favorable recommendations, according to the lawsuit.

Ms. Green says she was harassed for almost 2 years until she took a leave of absence in September 2015. She has not returned to work since. Dr. Ashok reportedly still has privileges at the hospital.

"This is unfortunately a case where a hospital has put its own financial and litigation interests over those of its patients and employees," says Mr. Little, the attorney for Ms. Green and Ms. Miller. "Despite the undeniable, shameful misconduct that is documented on video, no patients have been advised that their health might be compromised."

His clients are reportedly seeking unspecified damages for sexual harassment, unlawful sexual battery in the workplace and retaliation.

Adventist Medical Center says it a statement that it pledges to preserve a work environment free of sexual harassment, and calls any allegations of cover-up "false and misleading."

Risa Stuart, the attorney for Dr. Ashok and Mr. McGrory, did not respond to a request for comment.
